What is the Florida Digital Bill of Rights?

The Florida Digital Bill of Rights (FDBR) is a consumer privacy law that gives Florida residents greater control over how certain businesses collect, use, and share their personal information.

The law became effective on July 1, 2024, and establishes privacy rights for consumers while placing obligations on a limited number of large organizations that meet specific legal criteria.

Unlike many other state privacy laws, the FDBR primarily targets large technology companies and businesses with substantial revenue rather than applying broadly to all organizations.

Does the Florida Digital Bill of Rights apply to my business?

For most small and mid-sized businesses, the answer is probably not.

The FDBR applies only to certain for-profit organizations that conduct business in Florida, generate significant annual revenue, and meet additional requirements established by the law.

Although many businesses won't be directly subject to the FDBR, following privacy best practices can help build customer trust and prepare for future privacy regulations.

What rights does the Florida Digital Bill of Rights provide?

The FDBR provides eligible Florida consumers with several important rights, including:

• The right to access personal data.
• The right to correct inaccurate personal data.
• The right to delete personal data.
• The right to obtain a copy of personal data.
• The right to opt out of certain uses of personal information, including targeted advertising and the sale of personal data where applicable.

Businesses covered by the law must also provide consumers with a way to exercise these rights.
