Understanding California's consumer privacy law.

What is the California Consumer Privacy Act?

The California Consumer Privacy Act (CCPA) is one of the first comprehensive privacy laws in the United States. It gives California residents greater control over how businesses collect, use, share, and sell their personal information.

The law took effect on January 1, 2020, and has since been expanded by the California Privacy Rights Act (CPRA), which introduced additional consumer protections and created the California Privacy Protection Agency (CPPA).

Does the CCPA apply to my business?

Not every business is covered by the CCPA.

Generally, the law applies to for-profit businesses that do business in California and meet certain thresholds established by California law. These thresholds consider factors such as annual revenue, the amount of personal information collected, and whether the business derives significant revenue from selling or sharing personal information.

Even if your business doesn't currently meet these requirements, privacy regulations continue to evolve, and many organizations choose to adopt privacy best practices regardless of legal obligations.

What rights do California consumers have?

The CCPA provides California residents with several important rights, including:

• The right to know what personal information is collected.
• The right to request deletion of personal information.
• The right to correct inaccurate personal information.
• The right to access the information a business maintains about them.
• The right to opt out of the sale or sharing of personal information (when applicable).
• The right to limit the use of certain sensitive personal information.
• Protection against discrimination for exercising their privacy rights.

CCPA vs. CPRA.

The California Privacy Rights Act (CPRA) did not replace the CCPA—it expanded it.

Many people still refer to California's privacy law simply as the "CCPA," but today's law includes additional protections introduced by the CPRA, including expanded consumer rights and increased regulatory oversight.
